The FCC set the rules for the Analog Tv Spectrum Auction. A little bit of the OpenNet, but that's like a half-FreeMarket. Not as good as [z2007-07-22-GoogleOpenBroadband]

Om Malik came out in favor of truly Open Spectrum. Good for him! Some commenters think it's not feasible at the power levels involved.

Sept13 update: Verizon is suing the FCC to strike down even those rules.
