different agencies are within different Three Branches
some within the Executive Branch are "independent" of the Executive Department-s. Established through separate statutes passed by the US Congress, each respective statutory grant of authority defines the goals the agency must work towards, as well as what substantive areas, if any, it may have the power of rulemaking over.

- some consider these independent enough to qualify as a Fourth Branch of government.
